Trying all capital murder cases as being subject to the death penalty may make sense.

However, I also believe that it makes sense for a judge, upon conviction, to have the option of considering both mitigating and aggravating circumstances that may apply to a particular case when deciding upon the sentence. Cases where there is a sizable preponderance of the latter deserve a death sentence IMO.
