How would you like to be a juror on this case?

A few weeks ago in the Houston area, a gentlemen heard someone breaking into his neighbor's house. He called 911 to report what was happening! The 911 operator told the caller several times to remain in his home and not to confront the individuals. The caller advised the 911 operator that he wasn't going to allow the home invaders to get away and that he would shoot them. His actual words were that he would "kill" them.

Upon seeing the burglars getting ready to leave the neighbor's house, the caller, while still on the phone, went outside with a loaded 12 gauge shotgun. He yelled at the two individuals that if they moved they would be "dead". On the 911 tape there then could be clearly heard three shotgun blasts.

1) Both men were shot dead.
2) They were both illegal aliens, with prior police records.
3) Both of the men were hit in the upper torso area with entry from the back.

How would you rule? I don't know as for myself! When does an individual become the judge, jury and executioner in protecting a neighbor's property?
