The Illinois state legislature had passed a law — to take effect Jan. 1 — prohibiting employers from enrolling in the federal government's E-Verify program. In September, the federal government challenged the statute in court, and the state agreed Thursday to suspend the law pending negotiations. The state requested and was granted 60 days to propose changes and revamp the legislation during the next state assembly, and it agreed not to enforce the law until the lawsuit is resolved. "Illinois employers will now have the ability to verify the legality of their work force without interruption or fear of reprisal by the state," Homeland Security Secretary Michael Chertoff said. "I remain hopeful that Illinois will amend its law so that Illinois employers can continue to utilize this valuable tool without the need for further litigation." State lawmakers had opposed the system, saying the database was not accurate and would produce too many false positive results. E-Verify allows employers to determine, through an online system that matches Social Security numbers, whether an individual is a legal citizen or using fraudulent or stolen information. The system also has a photo tool that allows employers to compare the photo on a person's driver's license or ID card to federal databases. More than 30,000 employers, including nearly 1,000 in Illinois, have enrolled in the free program. More than 3 million new employees were checked nationwide using the system last year.<
