ITC decisions are administrative rulings. In order to appeal to the circuit court, Qcom would have to exhaust its administrative remedy. In other words, it had to make an appeal to the President before it could appeal. Remember, the circuit court kicked out the first request for a stay due to lack of jurisdiction, because the Presidential review period had not expired. Simply put: Qcom had no choice; it had to ask for presidential review or it would have lost its right to appeal to the court system.
