The new year has seen a lot of people doing just that, recognizing that "fiduciary responsibility" has become a running joke among the CEO's and boards of directors of the Fortune 500.

These guys loot fortunes for themselves out of other people's money, that's been entrusted to their care.

I'm pretty much in agreement, for about a decade I've been saying:

A buyback is not the same as a dividend
A buyback is not the same as a dividend
Ad infinitum

It appears that lately some financial journalists are finally starting to agree that hard, cold cash in your pocket is not the same as a buyback made with borrowed money while the stock is at a 52 week high.

But I disagree on the solution, imo the solution is to educate the general public; all markets that have ever existed serve primarily to benefit the insiders (but for that there would be no reason to create the market to begin with; why would you create a market that does not disproportionately benefit you?). This has proven true for hundreds of years.

I am 100% okay with playing in a poker game where I know that the game is rigged; the problem comes when an innocent person is falsely lured into believing the game is NOT rigged, and invests his or her life savings on that basis.

Imo the solution of that problem is disclosure, not regulation.
