That is the inevitable result of government tinkering. Free goods demand exceeds supply.

It isn't a free market. And the surcharge is imposed by the government.

Without the government intervention you wouldn't have the surcharge. The claims would either fall on some re-insurer or they wouldn't get paid. Companies that where financially shaky would tend to get pushed out not only because of any direct difficulty paying claims but because they would have a harder time attracting clients at least if they don't re-insure a lot of the risk (but the cost of doing so cuts profits).

Government insurance schemes are also subject to not having enough funds to pay, but governments can impose surcharges or raise taxes.
