not if there are 60 dem senators which appears distinctly possible. but even if not as the dems found out you have to approve someone and you were happy with alito and roberts, no? Larry Tribe would get thru i think. There are others who are hard working judges who have bipartisan support in their states like alito and mukassey had. And just like roberts and alito vote with scalia, the dems will choose folks who vote like the liberals on the court. You better get that shot gun of yours registered. (g)
