I don't know enough about Constitutional law to know for sure, but I remain sceptical of the legitimacy of Congress creating a new birthright. All Americans are entitled to life, liberty and the pursuit of happiness. I suspect that free health insurance would have to come under the pursuit of happiness. That is the right to pursue it, not the right to be happy or the right to free medical care.

OTOH I'm not sure I see any constitutional justification for it.

Of course in modern times (post FDR at least) interpretation has come close to "anything that isn't expressly forbidden to the feds is allowed. I don't think that such a program would be more unconstitutional than many other government programs.
