If he behaved unethically but not criminally than he should get away with it (in the sense of not being prosecuted, not necessarily in terms of avoiding any other fallout or negative reaction).

If he behaved criminally and unethically and gets away with it (except perhaps some blow to his reputation which I guess he can live with), than that's a bad thing, but it has nothing to do with tax rates.

Even if he defrauded people to get his money, his fraud (or other unethical and/or illegal conduct) shouldn't be used as a pretext to punish wealthy people who didn't act like he did.
