When you are guilty the best way avoid getting caught lying is not to dispute the facts but rationalize your choices. In other words try to spin why you did what you did or did not do. Always deny your intent. 2. If you can’t spin don’t. It is better to commit the sin of omission than commission. Another trick to avoid perjury is memory loss. You must have selective memory of your actions and when cornered (since you cannot use rule 1) and answer I do not recall or I do not remember. 3. Appear stupid since being ignorant is not by itself a crime. In other words say that everything was reviewed by people smarter than you (blame the CEO, CFO, internal auditors, external auditors, and Board members etc.) You just tell everyone you were not as detail oriented and as smart as your compensation and position would have everyone believe. Now I would NEVER counsel anyone to use such rules and if you are guilty (you know if you are) you should save everyone the time, trouble, and resources and take the fifth. You are far better off settling early and putting your criminality behind you than to make your adversaries (the government and civil plaintiffs who are after you) expend enormous resources investigating you to seek out justice. It is far better in the end to face mercy of your victims and sentencing Judge than their anger. So often those (including myself) have thumbed their nose at our justice system by following the three rules I have outlined above. I am sure everyone reading these rules has seen the same old, same old from many business persons and government officials today - time and time again. You should be disgusted by the lack of taking responsibility and accepting accountability. Unfortunately, I learned about humanity and morality the hard way and almost too late from the stark realization that had I not taken responsibility, accepted full accountability, and become willing to face the consequences of my brutal criminality I would be writing this comment from a prison cell instead of my home.
