An excellent point!

But --- under the 'Bush Doctrine', which I whole-heartedly AGREE WITH... if a country ALLOWS or in any way ENABLES or SUPPORTS non-state actors who launch attacks against America from sanctuary in that other nation... then the United States is FULLY and LEGALLY JUSTIFIED in declaring war against that enabling country.

(We did it against Afghanistan....)

So, what you mention above might really be a 'distinction without much of a meaning'.

If we are attacked, and we then have the necessary guts, there is no reason why a formal declaration of war cannot be pursued.

(And... there are many reasons why that would likely be the MOST EFFECTIVE choice to make.)
