That is because Bush has defined illegal activities as being legal for the President to commit. And Congress, both when there was a slight GOP majority and now when there is an even smaller Democratic majority, has rubberstamped Bush's anti-Contitutional power grab.

The funny thing about Nixon was that McGovern was no real threat to him. The much decorated combat hero of WWII was painted as a coward by the GOP and the smear stuck. This was already reflected in the polls when Don Nixon ordered the family to break into Democratic Party HQ.

The other funny thing is that he kept the tapes. I'm no criminal mastermind, but that was stupid with a capital S.
