It is a desire by EC to prevent any company from having a dominant share in an industry regardless of how the share is achieved. The %-age is the key. Nelli Kroes and another commissioner already in public speech said explicitly the high share is proof of undesirable state in the industry and their actions have the goal of reducing the large share.

Intel's will of course appeal to the fact there is no law that outlaws high share per se. Only specific bahaviours are to be prevented.
