And thats in straight normal English definitions, or economics terms. As a legal matter, export control laws explicitly cover communications, even if not paid for.

That doesn't give the government the power to wiretap and listen to every communication leaving the country. I am sure the terrorists are not using any communication that is considered an export of data related to goods and services. That power comes from the lack of rights for those abroad, especially non citizens, and the power to protect the country as well as to work in foreign affairs, the latter includes spying on our enemies.
