It has to do with the issues of whether communication can be an export.

Exactly how much authority the feds have to control these exports and what tactics they are allowed to use is a bit more complex.

I don't see the idea of wiretapping communications with enemies who we are at war with to be clearly illegal or unconstitutional. Apparently you do.

Of course there is always the argument that if you give the government an inch they will take a mile, but the discussion here has been about the legality of the inch, not the desirability of it. Also in a case like this 1 - A legitimate argument can be made that the "inch" is very important, and 2 - To the extent that the surveillance happens in secret, giving an inch is hardly necessary in order for the government to take the mile anyway.
