It's not only an issue of controlling exports, but also that surveillance of foreign enemy combatants is an inherent part of the job of commander and chief. It would be rather bizarre if Bush has the power to drop a bunker buster on their head, but not to listen in on their communications to make sure the bunker buster hits the right target.

I recognize this isn't a declared war, but none of our wars since WWII where (and we also had wars before WWII that were not declared).

If the Nazis tried to communicate with a German spy in WWII should American authorities have had to received a warrant before ease dropping on the conversation?
