In the short run it would definitely shake up the market. But it may be the shake out that is needed to truly mark to market the cdo's so we can move on instead of everything being veiled in secrecy. This new bankruptcy proposal was allowed previously in Chapter 13's as a type of cram down and it did not at that time create much of a problem, but times were different then especially the mortgage securitization market.
