Any big tax change like that will have effect on a lot of our plays, even flakey little juniors lacking anything drilled off yet, as many hold at least some of them long term, even when people trade actively many tend to trade around core positions and are sitting on gains ... and definitely there is strong fear that Dems will poof the LTCG

What i would do in this situation though, is try to off shares as high as possible, then turn right around and put the cash on the bid, try to get them back a few per cent lower ... assuming you would otherwise have held, you're taking the long view to homerun ... because the thirty-day rule wouldn't apply when you're taking profits? .. [maybe that's not true, dunno, best to get advice from a pro on it]

When tax regimes change the stocks you're holding, there's something wrong with the world ... system is way too complicated already north of the 49th, probably south as well from what i hear ... it's less than forty years that the g.w.n. even had a stupid capital gains tax

any chance this could be applied retroactively, ie for '08 tax year?

edit: i mean elimination of 15% LT cap gain rate.
