Not so. No one has to offer a private plan that doesn't assume Medicare coverage as primary. If no one sells one, then you are effectively prevented from buying one.

There is no law preventing it, but there has to be such a plan in order to buy it, and Medicare drives any such plan out of the market.

You can of course avoid Medicare by not having insurance (or effectively "self insuring")
