Stan, there's going to be electronic discovery, as well. Recall those e-mails that became the focus of the Rudi Brewster fiasco? As for your contention that the filing of lawsuits by two parties, in a vacuum, don't give rise to an inference of conspiracy or concert of action, no dispute there. However, when six complainants co-ordinate a joint assault before the EC, two of them are BRCM and NOK, who also file co-ordinated legal attacks on Qualcomm's business model, BRCM refuses to negotiate unless QCOM waives all royalties on the handset level, and the six EC complainants share PR personnel,who co-ordinate the media side of the assault, and whose factual admissions may be binding on the six based upon principles of agency, sufficient inferences can be drawn to support considerable discovery.Plus, it's apparent that Qualcomm has additional evidence, including e-mails.
Incidentally, on the Nokia thread, Eric asserts the pleading referenced in the Union Tribune piece was filed not in the Nokia case, but rather the New Jersey Federal Broadcomm case, that was partially reversed on appeal.
