You are right that a cap implies the charges are not proportionate mathematically speaking. I don't think that matters.

I don't even think being right or wrong matters. I think being able to argue matters.

Remember, the WHOLE ISSUE here in the Nokia case is so that Nokia can throw up barriers to injunction. If Nokia can show that Qualcomm has not made absolute best effort to live up to Qualcomm's obligations, then Nokia can block injunction, and stick the proverbial fork in Qualcomm.
