The problem is cases like Spitzer where the public and the personal get very mixed up. And while I can see where lawyers and police can abuse their discretion, I have no doubt many real crimes involve personal conduct by little people who would just as soon keep their peccadilloes (and maybe crimes linked to them) hushed up. I see your point but I don't know how you operationalize it and still meet the needs of justice. But we disagree so let's leave it there. Last word to you if you like.
