I disagree with the fiduciary duty to the seller thing, but it does appear to the the law even if it is ridiculous.

Re the buyers, they might consider hiring someone well-versed in the law to explain these things to them ... someone with a real fiduciary obligation ... and whose loyalty is unquestioned ... or they might decide to save a few hundred bucks and blow it off.

It's their choice.

One of the things Tanta has been saying on CR's blog is that the vig or friction historically associated with the purchase and sale of loans has been disappearing in recent years, but there was a very good reason that friction existed to begin with ... the same is true with the purchase and sale of homes, buying a $1.2m home is not the time to start pinching pennies.
