Said checks and balances are all part of the system, which can be exploited.

Steven Greenhut, the senior editor of The OC Register, is an expert on how government exploits eminent domain. Everyone realizes the benefits of eminent domain, but the safeguards have not prevented constant exploitation by those in power from seizing any property they get their eyes on. The methods vary widely, but the result is the same.

Now I'm not sure how libertarianism is supposed to fix the problem, but I can tell you that Greenhut is a strong libertarian.
