Nokia may doubtless make any argument that it thinks will bolster its position, but the time lapse regarding the extension agreement probably has nothing to do with the core issues. The principal that "A contract is construed against the author" is actually rather narrow. The licensing agreement is not a contract of adhesion (e.g., insurance contract) but was negotiated by two capable parties; the fact the weird extension is in there (at Nokia's behest) shows that the contract was negotiated.
