I have to agree with boondoggler on this one. You are overlooking the obvious. If Nokia should lose any part of this court case, their stock price will suffer greatly. Regardless of how much this will actually effect Nokia's overall business or negotiations with Qualcomm, investor perception will cause the stock to drop substantially.

This is a huge consideration for the management. I don't think that Nokia's Board will be nearly as supportive as Qualcomm's Board has been.

Good points, although I don't know how anyone, even the EC, can rightly say that Q is obligated to offer Nok a contract when they already had one and Nok was proven to breach and steal, instead (We don't care if Nok will breach the next one and continue to steal your IP, you must offer them a contract - yeah, that makes a lot of sense).
But if the headlines come out that Nok is in breach, and there is no contract, then the tables have turned big time, and Nok's bullshit game of attempting to bring Q's stock down because 'Q is the bully' is over. And it will be more than Nok's cash hoard that is affected.

Easy for you to say, but if you were a Nokia officer, would you be willing to roll the dice for the company on this trial?

Personally, I don't think it will reach trial.
