USA is, dumbass and must abide by the conventions. Al Qaida is NOT a Nation you p*sspot and it doesn't matter if they signatories or not. Mary Robinson, the UN human rights chief, said they (Al Qaida) should be considered prisoners of war, as defined by the Geneva Conventions.

The USA can't unilateraly declare them "detainees" or "unloawful combatants". Even if they are independently found to be "unlawful combatants" they still have rights under international humanitarian law – to humane treatment, to a fair trial if charged with a crime, and not to be tortured.

One, for instance, could call drug dealers "unlawful citizens" and start torturing them too. Even in the USA there are laws on treatment to incarcerated people.
