Seems that your post is dedicated to finding nuances that would permit the torture of some individuals or groups of individuals, organized or not organized. There is not document that complies with that condition. Clinging to the term terrorist is arbitrary and can be used by either of the warring parties. Uniforms, for example, are not a requirement to exclude you from terrorist designation. We have military units that do not wear uniforms.
There is also another Geneva Convention(IV) in addition to GCIII and of the UN Convention. All have, as a central theme, the treatment of prisoners not matter what name you give them....ie they are human beings and torture is torture.
