because it's a moral and religious issue What status it has as human, or what is required to give it special status is a moral issue (not really a religious issue to much, but a moral issue where religion influences the moral decision). But whether its a human is pretty much a biological issue. Its a member of the species homo-sapiens. Whether being a human is enough for the unborn child to properly deserve legal protection, is a moral issue and can reasonably be seen as a human rights issue.
