One could make the argument that Slavery and Segregation (Jim Crow laws) are manifestations of a belief system. The same as violence and hate speech.

You can make the acts illegal, but you can't regulate what's in peoples hearts.

Yes but the point is there are no statutes outlawing racism because from a legal perspective "racism" has no meaning whatsoever, it would be impossible to prove the crime, before you can convict someone of a crime you have to be able to explain what exactly he did that is illegal.

If you as a prosecutor begin your opening argument with "ladies and gentleman of the jury, the defendant stands accused of giving a black person the stink eye" the judge is going to be all over you like white on rice.
