There has been the claim that al Qaeda is an American invention. Seems that bin Laden needed to be the head of an organization to be tried in absentia under RICO over the WTC bombing in 1993. So the DOJ took a name that has been associated with bin Laden and went ahead.

However, bin Laden does seem to be associated with a group who has carried on at least some operations in an organized fashion. It is complicated by the fact that there are groups who also associate themselves at least publicly with al Qaeda even though there isn't any organizational connection. al Qaeda in Iraq seems to be one of those cases.

That does seem to be the case. Also, there is a tendency to link any radical Islamic terrorism to al Qaeda, at least initially.
