Qualcomm's Answer to Nokia in the Delaware Court is not concerned with patent infringement per se; rather Nokia's actionable cause is breach of the SULA(Subscriber Unit License Agreement)between itself and Qualcomm.
Read the Answer carefully. This is far and away Qualcomm's strongest argument against Nokia. Nokia will owe royaties to Qualcomm simply because Nokia continues to use Qualcomm's proprietary technology without paying Qualcomm.
