I know of no one who has taken that position. But the idea that there must be severe pain or suffering seems reasonable, and it is hard to argue that waterboarding delivers that.

Yeah! I think Yoo stopped a little shy of "die".

If we caused an organ to fail, then it would be torture too. So, in theory, we could beat a prisoner about the kidneys until he was pissing blood. As long a the organ was still "working", it wasn't torture! Or we could rape them repeatedly with cylindrical objects anally! Not torture!

I wish we had a transcript or recording of Bush, Cheney, Rice and the rest determining the "rules".
