Thanks all for that feed back. Can we say that routine audits are only done in the prior tax year and audits of returns from farther back only happen if the IRS has evidence of fraud?

To recall how this line started, Franken's spokesman said - Franken was unable to reconstruct his tax situation prior to 2003 because those years' financial records weren't complete.

Would this be enough for the IRS to start an investigation, especially in light of Franken's other tax problems?
