There is US caselaw allowing what Q does. That's a small but important piece of the puzzle.

Settlement? Perhaps. I am not so sure.

I think Q got taken to the cleaners in the previous contract and might negotiate settlement more aggressively, decreasing the chances of a compromise. Since Nokia is IMO happy to simply delay the day of reckoning, the dynamics do not point to settlement.
