The Senate can turn down SC nominees on whatever grounds it can get enough votes for.

Sorry if I was unclear. Of course they CAN. There are lots of things that we CAN do that compromise our system as it was set up. For example, the congress CAN skew the impeachment criteria and impeach someone for next to nothing. Statesmen don't do everything the CAN do. They are circumspect out out of respect for the system.

Clinton worked that process about as welll as it could be worked by working with Oren Hatch, the chair of the Judiciary Committee, before sending nominations forward.

A good example of what I said I preferred.
