Its still an unrealised loss. Furthermore the bank had the opportunity to accept the RE at the full principal of the loan and carry it on its books (and write it off much later).

Now they have an incentive to really lowball the price and maximise the loss. The former debtor doesnt need to pay tax anyways.
Is that an intended consequence of the COD gains taxation exemption?
