Only if the below-tot-cost price lasted forever. But regardless, that is not the criteria of US courts. Courts use marginal cost. (or its simpler-to-calculate sibling, avg variable cost). They expressly do not agree with economaniac that fixed cost should be part of the calculation. it doesn't matter what you, I and eco think the equation should be. the courts use their own.
