Perhaps this is why it's novel? It's already been rejected by the Courts and AMD is trying it again.

The concept has not been rejected, an insufficiently supported application of the concept was rejected.

Edit: (or several) :)

And don't forget that the LePage's vs. 3M case, which is very similar to AMD's complaint, was prosecuted successfully and upheld by the USSC (not insignificant precedent) by the same law team prosecuting AMD's case.

While precedent will be an important factor in the trial, it will ultimately depend upon the particulars of this individual case.
