I believe I am the one who brought the term "novel" into the discussion. I hope you won't think I was lying to the Judge...

Intel actually said AMD's position "is clearly at odds with case Law" and "AMD's position has no basis in Law". That's Intel's argument.

Intel cites numerous instances of case law and also quotes Justice Breyer: "when prices exceed incremental costs, one can not argue that they must rise for a firm to stay in business. Nor will such prices have a tendency to exclude or eliminate equally efficient competitors".

Interestingly enough, Intel's filing also says AMD makes only one specific claim of below-cost pricing.
