Are these royalties negotiated directly with providers for ODM phones that the providers are designing? Otherwise wouldn't the handset company selling the handsets to the provider pay the royalty?

All previous hype notwithstanding, this is a most significant news item.("China Telecom has announced a strategic tie-up with Qualcomm to use its CDMA technology...
Post-restructuring, Qualcomm will get about 4% in licensing fees from patents it licenses in CDMA2000 and WCDMA. It will also get royalties from China Netcom for all 3G WCDMA phones it sells.")

I am surprised at the relative lack of attention given this, although some of the analysts have slightly upped the target prices and revenue - although minor with respect to the real implications!
