It is this way. The president is supposed to make those appointments with the advice and consent of the Senate. Note, the Senate is not a rubber stamp.

Obama was merely fulfilling his constitutionally mandated obligations. The fact that you feel the Senate is supposed to approve any appointment just because they can't come up with a rock solid reason not to shows you don't really understand the process.

If a president choses not to work with the Senate when making appointments, which Bush chose not to do, it is incumbent on the president to make the case for the candidate.
