Protecting the rights of human beings accused of a crime is not what Al Qaeda does best. That's what people in democracies, who care about the rights of people, do. Al Qaedans are the kind of people who'd put you in a cage and NOT let you have a trial- or just kill you, or torture you. People who do THAT are like Al Qaedans.

Some people continue to believe that the goal of those who are concerned about things like habeas corpus are interested in protecting the guilty, whether they be terrorists or common criminals. That's the fundamental misunderstanding here.

The Justices who voted with the majority in this case are trying to protect innocent people who have been apprehended by mistake. That is a worthy, freedom-and-justice-affirming choice. Habeas Corpus is a fundamental legal principle that protects the innocent.

I don't think affirming it has anything to do with a pissing contest.
