Seems to me it turns on whether the U.S. is sovereign with respect to gitmo. If the U.S. can build a prison camp somewhere that it is clearly not sovereign it would be a way around the issue.

I didn't read the decision closely, only the articles about it with the selected quotes. But, as I read the articles, the SC says, as clearly as it can, that it cannot be done in Quantanomo (sp??). I've seen a good bit of speculation that it will lead to increasingly putting prisoners in prisons in other countries.

But that answer presumes an administration that has no respect for the constitution. Hopefully, that will not be the case in the future.
