How does "not worse than many others..." even vaguely resemble "OK" in your mind. If you arrest a murderer and a mugger, you don't let the mugger go, or otherwise not really care about him, because his activities where not worse than the murderers. You certainly don't say that what he did was ok. (Note: I'm using definite serious criminals to make a clear analogy, I'm not saying that Angelo Mozilla is definitely a serious criminal, nor am I arguing that he did nothing criminal.)
