"That's a false dichotomy with respect to our system of government." Let's take an example. Failure to legislate cap and trade will allow coal fired power plants to be built. Litigation to make the polar bear endangered provides a litigious way to stop the plant. What the politicians would not do a judge somewhere will - just watch. That way - when the lights start going out only some federal judge will be to blame. What I am really waiting to see is some suit to stop coal exports.
