Since I agree with you philosophically, it's hard for me to argue the other side at this point, but there are exceptions to habeas corpus, and that's what the opposition is arguing. That this is one.
The idea that our constitution is for Americans, and has nothing to do with prisoners of war, or rebellion, or attacks, or whatever the heck we are defining- or unfortunately NOT defining-is not uncommon.
