That's what the law about free speech is all about. It only matters in the cases that involve speech that is distasteful to someone. If the speech wasn't problematic, the case never would have arisen in the first place.

Free speech laws will only ever matter at the edges of culture- where speech is probably highly offensive to someone or other. But a culture that can protect that speech- realizing that such speech may also be the harbinger of needed social change, or new ideas- is a society that will have more freedom, and more new ideas than a more repressive society.
