It seems more natural to handle this internationally via the intel apparatus. Naturalness is an excellent quality to have in a system. Contrived, not so much. Convoluted, fatal.

Your point speaks only to intel. I don't know if your thinking is limited to that or if you are thinking about intervention and justice applied internationally, as well. I think the main "obstacle" there is that other countries are independent entities. We want to control everything and everybody. That some identified terrorists would end up being released by their countries of origin is a concern, but if we can't hold them without trial and we can't convict them in our courts of law, we might as well let the home countries deal with things as they see fit.

The second "obstacle" there is that, were another 9/11 to occur, this country would merciless blame our leaders for not having "done something." They aren't willing to risk that.
