Indeed, the decision is narrow. I haven't been addressing the decision but the broader question.

I saw that. But it's important to note that the decision is only imperfectly related to what you consider to be the broader problem. For instance, I think you raised the issue of Miranda warnings on the battlefield. If you meant that as a joke, then fine.

But if you meant that seriously, it's extremely important to note that (a) Kennedy's text doesn't get even close to that issue, and (b) raising it that way is becoming a way to undermine the decision itself, as if it were about battlefield capture.

What is your take on how we legally define wars that could very well go on for many decades or never end at all, as currently formulated?
